This essay starts from the observation that the issue of talent, in relation to the problem of distributive justice, can be approached from two different angles. First, it is common to discuss the justificatory function of talent, that is, its role in the justification of educational or social inequalities. In addition, however, this essay proposes to look at practices of talent ascription and their causal role in the distribution of educational prospects. These practices tend to exacerbate educational inequalities due to (...) social background, especially when they are tied to selective educational settings. There is reason to avoid talent-based selection in education, in order to contain the negative effects of practices of talent ascription. (shrink)

Brain-computer interfaces are envisioned to enable new abilities of action. This potential can be fruitful in particular when it comes to restoring lost motion or communication abilities or to implementing new possibilities of action. However, BCIs do not come without presuppositions. Applying the concept of ability expectations to BCIs, a wide range of requirements on the side of the users becomes apparent. We examined these ability expectations by taking the example of therapeutic BCI users who got enrolled into BCI research (...) studies due to particular physical conditions. Some of the expectations identified are quite explicit, like particular physical conditions and BCI “literacy”. Other expectations are more implicit, such as motivation, a high level of concentration, pain tolerance, emotion control and resources. These expectations may produce a conception of the human and a self-understanding among BCI users that objectify the body in favour of a brain-centred, cerebral notion of the subject which also plays its part in upholding a normality regime. In this paper we address the question how children come to understand normativity through simple forms of social interaction. A recent line of research suggests that even very young children can understand social norms quite independently of any moral context. We focus on a methodological procedure developed by Rakoczy et al., Developmental Psychology, 44, 875–881, that measures children’s protest behaviour when a pre-established constitutive rule has been violated. Children seem to protest when they realize that rule violations are not allowed (...) or should not have happened. We point out that there is more than one possible explanation for children’s reactions in these studies. They could be due to disobeying an authority, an inability to follow a rule, or the violation of an empirical expectation due to the mismatch between statement and action. We thus question whether it would still count as an indicator for normative understanding if children responded to aspects of the game other than the violation of a constitutive rule and conclude that the protesting behavior, when taken in isolation, does not suffice as evidence for normative understanding. The rapid expansion of research on Brain-Computer Interfaces is not only due to the promising solutions offered for persons with physical impairments. There is also a heightened need for understanding BCIs due to the challenges regarding ethics presented by new technology, especially in its impact on the relationship between man and machine. Here we endeavor to present a scoping review of current studies in the field to gain insight into the complexity of BCI use. By examining studies related to BCIs (...) that employ social research methods, we seek to demonstrate the multitude of approaches and concerns from various angles in considering the social and human impact of BCI technology. For this scoping review of research on BCIs’ social and ethical implications, we systematically analyzed six databases, encompassing the fields of medicine, psychology, and the social sciences, in order to identify empirical studies on BCIs. The search yielded 73 publications that employ quantitative, qualitative, or mixed methods. Of the 73 publications, 71 studies address the user perspective. Some studies extend to consideration of other BCI stakeholders such as medical technology experts, caregivers, or health care professionals. The majority of the studies employ quantitative methods. Recurring themes across the studies examined were general user opinion towards BCI, central technical or social issues reported, requests/demands made by users of the technology, the potential/future of BCIs, and ethical aspects of BCIs. Our findings indicate that while technical aspects of BCIs such as usability or feasibility are being studied extensively, comparatively little in-depth research has been done on the self-image and self-experience of the BCI user. In general there is also a lack of focus or examination of the caregiver’s perspective. (shrink)

When is it fair that some people are less healthy than others due to their own individual choices and preferences? In this paper, I explore two alternative answers. The first is a luck-egalitarian account that holds people responsible for choices that society could have reasonably expected them to avoid. I argue that this account is indeterminate and go on to sketch an alternative proposal based on Rawls’s idea of a “social division of responsibility.” This latter approach connects the notion of (...) responsibility for health to the social conditions under which health-related behaviour is developed. Against the background of worldwide, intentional or unintentional everyday violations of human dignity and the epochal need to experience oneself as a human being in one’s specific way of being, this article attempts to pursue the question of human dignity and its concealment. On the one hand, it seeks to ask whether human dignity has become obsolete due to social and epochal developments and preconditions and whether it can only appear and be experienced as antiquated in the context of a (...) technological language or an administered world. On the other hand, it asks whether ethical and anthropological thinking have not sufficiently experienced, thought, and conceptualized man. From the context of these perspectives that determine the question of dignity, Heidegger’s article seeks to take up Heidegger’s repeated search for an original ethics based on Heraclitus’ fragment 119, and from this point of view to ask for a perhaps deeper and more adequate understanding of human dignity. At the centre of this is Heidegger’s thesis that human dignity is based on the protection of the unhidden and, ever before, the hiddenness of all beings. Without wanting to ignore the difficulty and complexity of Heidegger’s thinking, the author seeks to find access to this understanding of our dignity based on the experience of personal encounters. In social evolution theory, biological individuals are often represented on the model of rational agents, that is, as if they were ‘seeking’ to maximize their own (expected) reproductive success. In the 1990s, important criticisms of this mode of thinking were made by Brian Skyrms ([1994], [1996]) and Elliott Sober ([1998]), who both argued that ‘rational agent’ models can lead to incorrect predictions when there are positive correlations between individuals’ phenotypes. In this article, I argue that one model of rational choice—namely, (...) Savage’s model ([1954])—can actually be vindicated in evolutionary biology, provided that the pay-offs are computed in inclusive fitness terms. I also show that the use of this model is better avoided when pay-offs are non-additive, or when certain causal influences (due to manipulative behaviours) affect the outcome of natural selection. According to the theory of appearing, veridical perception consists in an irreducible relation of appearing between a perceiving subject and a physical object. The paper sketches the development of the theory and its relation to competing views (sense data theory, adverbialism, representationalism). The most worked-out version of the theory, due to William Alston, is found lacking on several counts. First, Alston’s account of the phenomenal character of perception succeeds only if we disregard the possibility of illusion. Second, the account implies, (...) implausibly, that to be deceived by hallucination is to commit an introspective error concerning the phenomenal character of one’s own experience. Another unintuitive implication of the theory is that veridical perception involves not one but two objects appearing to the subject: the physical object perceived and a further, special object required to account for the possibility of hallucinatory experience. Finally, relative to its competitors, the theory of appearing is not in a privileged position to explain how perception can be a source of justification for empirical judgements. (shrink)

Brentano’s use of the expression ‘intentional inexistence’ poses a considerable terminological problem. This is due not only to the expressions ‘intentional’ and ‘inexistence’ contained in it. The biggest hurdle is the liberal use of the expression ‘object’, which is encouraged by Brentano’s notion of intentional inexistent (or immanent) objects. Carlo Ierna tries to meet this problem with a strategy that allows to hold on to the notion of intentional inexistence without accepting immanent objects. The originality of his interpretation lies, as (...) I will show in my commentary, in the fact that it tries to achieve its goal by terminological measures alone. Following the same line, I will argue that Brentano’s self-correction, made in the second edition of his Psychology, can also be interpreted in this context as a terminological move. (shrink)

BackgroundAn important principle underlying the Dutch Euthanasia Act is physicians' responsibility to alleviate patients' suffering. The Dutch Act states that euthanasia and physician-assisted suicide are not punishable if the attending physician acts in accordance with criteria of due care. These criteria concern the patient's request, the patient's suffering (unbearable and hopeless), the information provided to the patient, the presence of reasonable alternatives, consultation of another physician and the applied method of ending life. To demonstrate their compliance, the Act requires physicians (...) to report euthanasia to a review committee. We studied which arguments Dutch physicians use to substantiate their adherence to the criteria and which aspects attract review committees' attention.MethodsWe examined 158 files of reported euthanasia and physician-assisted suicide cases that were approved by the review committees. We studied the physicians' reports and the verdicts of the review committees by using a checklist.ResultsPhysicians reported that the patient's request had been well-considered because the patient was clear-headed (65%) and/or had repeated the request several times (23%). Unbearable suffering was often substantiated with physical symptoms (62%), function loss (33%), dependency (28%) or deterioration (15%). In 35%, physicians reported that there had been alternatives to relieve patients' suffering which were refused by the majority. The nature of the relationship with the consultant was sometimes unclear: the consultant was reported to have been an unknown colleague (39%), a known colleague (21%), otherwise (25%), or not clearly specified in the report (24%). Review committees relatively often scrutinized the consultation (41%) and the patient's (unbearable) suffering (32%); they had few questions about possible alternatives (1%).ConclusionDutch physicians substantiate their adherence to the criteria in a variable way with an emphasis on physical symptoms. The information they provide is in most cases sufficient to enable adequate review. Review committees' control seems to focus on (unbearable) suffering and on procedural issues. (shrink)

What is the concept of human dignity derived from? Does it have its foundation in the emotions or in reason? By dint of a differentiation between a premoral, sittliche orientation in acting and a moral orientation, which is due to an external evaluating moral community, the author comes to the conclusion that human dignity finds its foundation in both the emotions and rationality. In this study, we set out to examine the role played by country institutional environments in explaining cross-country variation in the prevalence of women on corporate boards of directors. In order to address this question, we compare the predictive power and substantive implications of four existing typologies of national institutional environments due to Hall and Soskice (2001), La Porta et al., (1999), Weimar and Pape’s (1999), and Whitley (1991, 1996, 1999). These frameworks encapsulate a variety of national institutionalcharacteristics and provide (...) a means to a) evaluate the significance of national institutional environments for the presence of women on boards, and b) distinguish between the importance of various specific aspects of country institutional environments for board diversity. Our findings show that as much as half of the variation across countries in the presence of women on corporate boards is attributable to institutional factors and that legally-oriented institutions appear to play the most significant role in shaping board diversity. Menos aún se habla de la filosofía de la historia, sobre todo porque ha caído en descrédito. Sin embargo, casi todas las argumentaciones emplean modelos de interpretación propios de la filosofía de la historia. Se conjetura qué tendencias generales le son inherentes a la globalización y si apuntan (...) a un “progreso” o a una “decadencia” de la civilización humana. Por último, el problema ético de la justicia global debe tomar en consideración el desarrollo de la historia acontecida. Estos temas dejan claro que el recurso a la historia con implicaciones filosóficas es imprescindible para resolver los problemas de la globalización.Contemporary theories of globalisation seldom mention history. This is surprising, because “globalisation” is essentially a term describing an historical process. There is still less mention of the philosophy of history, especially due to the discredit cast upon it. And yet nearly all of the relevant arguments operate with patterns of interpretation borrowed from the philosophy of history. The authors speculate on which general tendencies are inherent to globalisation and whether they are more indicative of the “progress” or of the “downfall” of human civilisation. Finally, the ethical problem of global justice requires us to take into account the course of history thus far. These topics underline that resorting to history with all of its philosophical implications is essential if we are to resolve the problems caused by globalisation. (shrink)

Through writings of Simone Weil and Michel Foucault, the article explores the notion of education as the formation of the attending and attentive subjects. Both writers have in different ways acknowledged the important relation between attention and the self. While Weil develops a spiritual form of attention, an attention which can be trained in any form of serious studying, aiming at dissolving the illusion of the self, Foucault understands attention as an important aspect in the Greek notion of the care (...) of the self, which was developed outside of and due to the limitations of pedagogy aiming at a self-attentive self-formation. Both non-egotistic notions of attention address ethical and educational dimensions of human subjectivity. Foucault’s notion is anti-institutional and Weil’s notion is non-formative. As such, both perspectives inform educational thinking and practice by highlighting attention as a crucial aspect of both the active and the contemplative subject. (shrink)

While organizations today make extensive use of complex algorithms, the notion of algorithmic accountability remains an elusive ideal due to the opacity and fluidity of algorithms. In this article, we develop a framework for managing algorithmic accountability that highlights three interrelated dimensions: reputational concerns, engagement strategies, and discourse principles. The framework clarifies that accountability processes for algorithms are driven by reputational concerns about the epistemic setup, opacity, and outcomes of algorithms; that the way in which organizations practically engage with emergent (...) expectations about algorithms may be manipulative, adaptive, or moral; and that when accountability relationships are heavily burdened by the opacity and fluidity of complex algorithmic systems, the emphasis of engagement should shift to a rational communication process through which a continuous and tentative assessment of the development, workings, and consequences of algorithms can be achieved over time. The degree to which such engagement is, in fact, rational can be assessed based on four discourse-ethical principles of participation, comprehension, multivocality, and responsiveness. We conclude that the framework may help organizations and their environments to jointly work toward greater accountability for complex algorithms. It may further help organizations in reputational positioning surrounding accountability issues. The discourse-ethical principles introduced in this article are meant to elevate these positioning contests to extend beyond mere adaption or compliance and help guide organizations to find moral and forward-looking solutions to accountability issues. The economic rationality is often not mediated with rationalities of professional standards or theological programs. Due to economical pressure, it becomes more and more difficult to maintain a value oriented service. On top of this, the function of ecclesiastical welfare institutions as an advocate for socially week people is in danger to get lost. Looking for answers, the article concentrates on presently discussed concepts of restructuring (...) institutions of church welfare. Bilder können dazu einladen, das bildlich Dargestellte für einen Teil der Wirklichkeit zu halten, sie können Gegenstand fragwürdiger Projektionen werden oder aber dazu beitragen, die Wirklichkeit selbst bildhaft erstarren zu lassen. Diese Gefahren im Umgang mit Bildern sind nicht zuletzt auf deren spezifische temporale Verfasstheit zurückzuführen, insbesondere wenn die physische Präsenz eines Bildes genutzt wird, um Vergangenes oder Abwesendes zu vergegenwärtigen. Der Beitrag entfaltet diese Problemlage an verschiedenen exemplarischen (...) Texten Goethes. Am Beispiel des Aufsatzes »Ruysdael als Dichter« skizziert er eine alternative Form des Umgangs mit Bildern, die nicht allein auf deren Präsenzeffekt setzt, sondern eine dem Bild eigene Temporalität im Prozess des Sehens und Reflektierens zur Geltung bringt.In many literary works, Goethe deals with problematic effects of pictures and their perception. Pictures can invite their viewers to take that what they represent as part of reality; they can become the object of questionable projections or encourage to freeze reality like a static depiction. These dangers in dealing with images are not least due to their specific temporal constitution, particularly when the physical presence of a picture is used to visualize the past or the absent. The paper unfolds this problem by referring to various exemplary texts of Goethe. Dwelling on the essay »Ruysdael as a poet«, it outlines an alternative way in dealing with pictures, which does not rely solely on their presence effect, but rather emphasizes a temporality that is inherent in the picture and can be put into effect in the process of seeing and reflecting. Dispositions and tendencies feature significantly in the biomedical domain and therefore in representations of knowledge of that domain. They are not only important for specific applications like an infectious disease ontology, but also as part of a general strategy for modelling knowledge about molecular interactions. But the task of representing dispositions in some formal ontological systems is fraught with several problems, which are partly due to the fact that Description Logics can only deal well with binary relations. The paper will (...) discuss some of the results of the philosophical debate about dispositions, in order to see whether the formal relations needed to represent dispositions can be broken down to binary relations. Finally, we will discuss problems arising from the possibility of the absence of realizations, of multi-track or multi-trigger dispositions and offer suggestions on how to deal with them. (shrink)

Although research assistantships are considered research learning venues in graduate education, there is a scarcity of literature that examines ethical elements attached to the employment of graduate student research assistants or the position of their research supervisors. This article explores the need to implement formal regulations specific to research assistantships in order to increase security and decrease risks for research assistants and research supervisors. Relationships between research assistants and research supervisors have some similarities with regular employment relationships; yet some distinct (...) differences arise due to the educational and developmental nature of research assistantships. The article is written from a dual perspective reflecting the authors' roles (a research supervisor and a research assistant, respectively) and institutional locations (Faculties of Education in South Africa and Canada). The authors draw from existing literature, an analysis of institutional policies and practices at their universities, and their personal and professional experiences to illustrate risks that research assistants and their supervisors may face within research assistantships. They assess the extent to which existing and proposed policies and practices influence working conditions and safeguard experiences within graduate research assistantships. The findings reveal that research assistantships are a unique form of employment focused on educational and professional development that requires specific documentation of expected standards of practice. The authors argue that lack of clear regulations exposes both parties to unnecessary risks and offer recommendations for creating a "Standards of Good Practice" document that will be useful for individuals engaged in research assistantships. There are three main positions on animalthought: lingualism denies that non-linguistic animalshave any thoughts; mentalism maintains that theirthoughts differ from ours only in degree, due totheir different perceptual inputs; an intermediateposition, occupied by common sense and Wittgenstein,maintains that animals can have thoughts of a simplekind. This paper argues in favor of an intermediateposition. It considers the most important arguments infavor of lingualism, namely those inspired byDavidson: the argument from the intensional nature ofthought (Section 1); the idea that thoughts involveconcepts (Sections (...) 2–3); the argument from the holisticnature of thought (Section 4); and the claim that beliefrequires the concept of belief (Sections 5–6). The lastargument (which Davidson favors) is uncompelling, butthe first three shed valuable light on the extent towhich thought requires language. However, none of themprecludes animals from having simple thoughts. Even ifone adopts the kind of third-person perspective onthought Davidson shares with Wittgenstein, the resultis a version of the intermediate position, albeit oneenriched by Davidson''s insights concerningintensionality, concepts and holism (Section 7). We canonly ascribe simple thoughts to animals, and even thatascription is incongruous in that the rich idiom weemploy has conceptual connections that go beyond thephenomena to which it is applied. The functional separation of risk assessment and risk management has long been at the heart of risk analysis structures. Equally long it has been criticized for creating technocratic risk management due to valuations being done in the risk assessment to which the stakeholders do not have access. The criticism has mostly been of an ethical nature. Arguably, in separating risk assessment and risk management, one hopes to fulfil two requirements: Social requirement: we want risk management to meet the goals and (...) needs of society. Scientific requirement: we do not want political views to influence the assessment of facts. We ask in this paper whether it is, in principle, possible to separate risk assessment from risk management. The crucial distinction between risk assessment and risk management we take to be between what kinds of values are involved in them and that separation is meant to shield risk assessment from risk management values and vice versa. Risk assessment is judged to be a scientific activity that should only involve scientific values. We go through a paradigmatic example of good science to see what those scientific values are and whether they are the only ones influencing science. We also present an example of a risk assessment in order to compare it to science. We conclude that the values involved in both science and risk assessment are of the same kind and that they both involve extra-scientific values. The paper ends with a short discussion of whether the above requirements can be met even though risk assessment and risk management are interdependent. (shrink)

P.F. Strawson and his Philosophical Legacy aims to bring out the continuing relevance of Sir Peter Frederick Strawson’s (1919–2006) work for current philosophical debates. It is the first collection of essays published after Strawson’s death that covers the full range of his work. The focus in contemporary work on Strawson is often on his relation to Kant or his paper ‘Freedom and Resentment’. While this volume gives due attention to these topics, it also includes essays on Strawson’s lasting contributions to (...) the philosophy of language, metaphysics, epistemology, perception, moral philosophy, and philosophical methodology. We are grateful for the thoughtful commentaries to our article on patient selection for first clinical trials of cardiac xenotransplantation1 because they give us the opportunity to clarify and further sharpen our arguments in this response. In our article, we proposed a multicriteria approach to selecting patients for first clinical trials of (cardiac) xenotransplantation, encompassing the four criteria medical need, capacity to benefit, patient choice and compliance (used as an exclusion criterion). We also argued that clinical trials following clearly defined (...) study protocols should be favoured over further single compassionate use cases to gather reliable and valid knowledge about the benefits and risks of xenotransplantation. Continuous poor outcomes in compassionate use cases can impede a technology’s development. For example, early heart transplants led to moratoria in several countries due to public and professional backlash. This historical concern is also echoed within the xenotransplantation research community and should be considered when arguing, as Aparicio et al do in their comment, for continuing the expanded access pathway to further establish clinical xenotransplantation.2 We agree with Aparicio et al that patients in general should have access to innovative treatment strategies via expanded access. In cardiac xenotransplantation, however, only a small number of patients can currently be offered a xenotransplant because of …. (shrink)

Purpose: Whereas ethical considerations on imaging techniques and interpretations of neuroimaging results flourish, there is not much work on their preconditions. In this paper, therefore, we discuss epistemological considerations on neuroimaging and their implications for neuroethics. Results: Neuroimaging uses indirect methods to generate data about surrogate parameters for mental processes, and there are many determinants influencing the results, including current hypotheses and the state of knowledge. This leads to an interdependence between hypotheses and data. Additionally, different levels of description are (...) involved, especially when experiments are designed to answer questions pertaining to broad concepts like the self, empathy or moral intentions. Interdisciplinary theoretical frameworks are needed to integrate findings from the life sciences and the humanities and to translate between them. While these epistemological issues are not specific for neuroimaging, there are some reasons why they are of special importance in this context: Due to their inferential proximity, 'neuro-images' seem to be self-evident, suggesting directness of observation and objectivity. This has to be critically discussed to prevent overinterpretation. Additionally, there is a high level of attention to neuroimaging, leading to a high frequency of presentation of neuroimaging data and making the critical examination of their epistemological properties even more pressing. Conclusions: Epistemological considerations are an important prerequisite for neuroethics. The presentation and communication of the results of neuroimaging studies, the potential generation of new phenomena and new 'dysfunctions' through neuroimaging, and the influence on central concepts at the foundations of ethics will be important future topics for this discipline. Several authors have detected profound analogies between Kant and Wittgenstein. Their claims have been contradicted by scholars, such being the agreed penalty for attributions to authorities. Many of the alleged similarities have either been left unsubstantiated at a detailed exegetical level, or have been confined to highly general points. At the same time, the ‘scholarly’ backlash has tended to ignore the importance of some of these general points, or has focused on very specific issues or purely terminological matters. To advance (...) the debate, I distinguish four different topics: questions of actual influence; parallels at the methodological level; substantial similarities in philosophical logic; substantial similarities in the philosophy of mind. The article concentrates on the second and third topic. Section I argues that the critical conception of philosophy shared by Kant and Wittgenstein is itself due to the fact that they explain the a priori status of necessary propositions by reference to the way we experience or represent reality. Section II shows how the Tractatiis linguistically transforms this ‘reflective turn’, replacing Kant's preconditions of experience by preconditions of symbolic representation. Section III suggests that this explanation of the a priori involves the idea of an isomorphism between thought and reality, and that both Kant's transcendental idealism and Wittgenstein's early metaphysics of symbolism distort this isomorphism. Wittgenstein later rejected this metaphysics of symbolism, on the grounds that language is autonomous, and section IV detects parallels between that idea and Kant's ‘diallelus’ argument against the correspondence theory of truth. Finally, I claim that while Wittgenstein is right to insist that all a priori propositions are conceptual, Kant, in calling them synthetic a priori, is right to deny that they simply unpack the concepts involved in the propositions themselves. Monitoring and assistive technologies (MATs) are being used more frequently in healthcare. A central ethical concern is the compatibility of these systems with the moral preferences of their users—an issue especially relevant to participatory approaches within the ethics-by-design debate. However, users’ incapacity to communicate preferences or to participate in design processes, e.g., due to dementia, presents a hurdle for participatory ethics-by-design approaches. In this paper, we explore the question of how the value preferences of users in the field of dementia (...) care can be integrated into AI-based MATs. First, we briefly introduce different ethics-by-design approaches and explain the challenges they face in dementia care. Next, we introduce a novel approach for addressing these challenges. Through a qualitative content analysis of interviews with persons with dementia and their family caregivers (n = 27), we identified multiple ideal–typical value preference profiles. We then applied these profiles in a computer simulation, by which we also introduce the concept of ethical compliance quantification to scale the moral preferences of the interviewees for the simulation. Finally, we discuss study results, the advantages of using computer simulations, and general study limitations before drawing conclusions for further research. The study contributes to the ongoing debate on participatory ethics-by-design by defining on the basis of empirical data ideal–typical value preference frameworks that can be used to guide MAT actions and their outcomes. Going forward, MAT end-users with dementia and other communication-impaired persons could be enabled to choose a value profile that best fits their moral preferences. (shrink)

In paediatric oncology, research and treatments are often closely combined, which may compromise voluntary informed consent of parents. We identified two key scenarios in which voluntary informed consent for paediatric oncology studies is potentially compromised due to the intertwinement of research and care. The first scenario is inclusion by the treating paediatric oncologist, the second scenario concerns treatments confined to the research context. In this article we examine whether voluntary informed consent of parents for research is compromised in these two (...) scenarios, and if so whether this is also morally problematic. For this, we employ the account of voluntary consent from Nelson and colleagues, who assert that voluntary consent requires substantial freedom from controlling influences. We argue that, in the absence of persuasion or manipulation, inclusion by the treating physician does not compromise voluntariness. However, it may function as a risk factor for controlling influence as it narrows the scope within which parents make decisions. Furthermore, physician appeal to reciprocity is not controlling as it constitutes persuasion. In addition, framing information is a form of informational manipulation and constitutes a controlling influence. In the second scenario, treatments confined to the research context qualify as controlling if the available options are restricted through manipulation of options. Although none of the influences is morally problematic in itself, a combination of influences may create morally problematic instances of involuntary informed consent. Therefore, safeguards should be implemented to establish an optimal environment for parents to provide voluntary informed consent in an integrated research-care context. (shrink)

Two decades of research on euthanasia in the Netherlands have resulted into clear insights in the frequency and characteristics of euthanasia and other medical end-of-life decisions in the Netherlands. These empirical studies have contributed to the quality of the public debate, and to the regulating and public control of euthanasia and physician-assisted suicide. No slippery slope seems to have occurred. Physicians seem to adhere to the criteria for due care in the large majority of cases. Further, it has been shown (...) that the majority of physicians think that the euthanasia Act has improved their legal certainty and contributes to the carefulness of life-terminating acts. In 2005, eighty percent of the euthanasia cases were reported to the review committees. Thus, the transparency envisaged by the Act still does not extend to all cases. Unreported cases almost all involve the use of opioids, and are not considered to be euthanasia by physicians. More education and debate is needed to disentangle in these situations which acts should be regarded as euthanasia and which should not. Medical end-of-life decision-making is a crucial part of end-of-life care. It should therefore be given continuous attention in health care policy and medical training. Systematic periodic research is crucial for enhancing our understanding of end-of-life care in modern medicine, in which the pursuit of a good quality of dying is nowadays widely recognized as an important goal, in addition to the traditional goals such as curing diseases and prolonging life. We report three studies in which we applied a value dictionary to narratives. Our objective was to test a theory-driven value dictionary for extracting valuable information from autobiographical and narrative texts. In Studies 1 and 2, participants wrote short autobiographical narratives and in Study 3, participants wrote narratives based on ambiguous stimuli. Participants in all three studies also completed the Portrait Value Questionnaire as a self-report measure of values. Overall, our results demonstrate that it is possible to extract value-relevant information (...) from these narratives. Extracted values from autobiographical narratives showed average correlations of 0.07 and 0.12 with self-reports compared to an average correlation of 0.01 for the extracted values from implicit motive tasks. The correlations with self-reports were in line with previous validation studies. The most salient values in narratives diverged somewhat, with a stronger emphasis on achievement values compared to self-reports, probably due to the nature of salient episodes within one's life that require demonstrating success according to social standards. Benevolence values were consistently most important in both self-ratings and text-based scoring. The value structure emerging from narratives diverged from the theoretically predicted structure, yet broad personally vs. socially focused value dimensions were qualitatively discernible. We highlight opportunities and challenges for future value research using autobiographical stories. (shrink)

Domesticated animals need to be treated as fellow citizens: only if we conceive of domesticated animals as full members of our political communities can we do justice to their moral standing—or so Sue Donaldson and Will Kymlicka argue in their widely discussed book Zoopolis. In this contribution, we pursue two objectives. Firstly, we reject Donaldson and Kymlicka’s appeal for animal citizenship. We do so by submitting that instead of paying due heed to their moral status, regarding animals as citizens misinterprets (...) their moral qualities and thus risks treating them unjustly. Secondly, we suggest that Donaldson and Kymlicka’s reinforced focus on membership should draw our attention to the moral standing of a further ‘species’, namely robots. Developments within artificial intelligence have advanced rapidly in recent years. With robots’ gaining ever greater capacities and abilities, we need to ask urgent questions about the moral ramifications of these technical advances. (shrink)

Social relationships are essential for humans; neglecting our social needs can reduce wellbeing or even lead to the development of more severe issues such as depression or substance dependency. Although essential, some individuals face major challenges in forming and maintaining social relationships due to the experience of social anxiety. The burden of social anxiety can be reduced through accessible assessment that leads to treatment. However, socially anxious individuals who seek help face many barriers stemming from geography, fear, or disparities in (...) access to systems of care. But recent research suggested digital behavioral markers as a way to deliver cheap and easily accessible digital assessment for social anxiety: As earlier work shows, players with social anxiety show similar behaviors in virtual worlds as in the physical world, including tending to walk farther around other avatars and standing farther away from other avatars. The characteristics of the movement behavior in-game can be harnessed for the development of digital behavioral markers for the assessment of social anxiety. In this paper, we investigate whether implicit as well as explicit digital behavioral markers, proposed by prior work, for social anxiety can be used for predicting the level of social anxiety. We show that both, explicit and implicit digital behavioral markers can be harnessed for the assessment. Our findings provide further insights about how game-based digital behavioral markers can be used for the assessment of social anxiety. (shrink)

There is considerable correspondence between theories and models used in biology and the social sciences. One type of model that is in use in both biology and the social sciences is the fitness landscape model. The properties of the fitness landscape model have been applied rather freely in the social domain. This is partly due to the versatility of the model, but it is also due to the difficulties of transferring a model to another domain. We will demonstrate that in (...) order to transfer the biological fitness landscape model to the social science it needs to be substantially modified. We argue that the syntactic structure of the model can remain unaltered, whilst the semantic dimension requires considerable modification in order to fit the specific phenomena in the social sciences. We will first discuss the origin as well as the basic properties of the model. Subsequently, we will demonstrate the considerations and modifications pertaining to such a transfer by showing how and why we altered the model to analyse collective decision-making processes. We will demonstrate that the properties of the target domain allow for a transfer of the syntactic structure but don’t tolerate the semantic transfer. (shrink)

There are three main positions on animalthought: lingualism denies that non-linguistic animalshave any thoughts; mentalism maintains that theirthoughts differ from ours only in degree, due totheir different perceptual inputs; an intermediateposition, occupied by common sense and Wittgenstein,maintains that animals can have thoughts of a simplekind. This paper argues in favor of an intermediateposition. It considers the most important arguments infavor of lingualism, namely those inspired byDavidson: the argument from the intensional nature ofthought (Section 1); the idea that thoughts involveconcepts (Sections (...) 2–3); the argument from the holisticnature of thought (Section 4); and the claim that beliefrequires the concept of belief (Sections 5–6). The lastargument (which Davidson favors) is uncompelling, butthe first three shed valuable light on the extent towhich thought requires language. However, none of themprecludes animals from having simple thoughts. Even ifone adopts the kind of third-person perspective onthought Davidson shares with Wittgenstein, the resultis a version of the intermediate position, albeit oneenriched by Davidson's insights concerningintensionality, concepts and holism (Section 7). We canonly ascribe simple thoughts to animals, and even thatascription is incongruous in that the rich idiom weemploy has conceptual connections that go beyond thephenomena to which it is applied. Ensuring that countries have adequate research capacities is essential for an effective and efficient response to infectious disease outbreaks. The need for ethical principles and values embodied in international research ethics guidelines to be upheld during public health emergencies is widely recognized. Public health officials, researchers and other concerned stakeholders also have to carefully balance time and resources allocated to immediate treatment and control activities, with an approach that integrates research as part of the outbreak response. Under such circumstances, research (...) “ethics preparedness” constitutes an important foundation for an effective response to infectious disease outbreaks and other health emergencies. A two-day workshop was convened in March 2018 by the World Health Organisation Global Health Ethics Team and the African coaLition for Epidemic Research, Response and Training, with representatives of National Ethics Committees, to identify practical processes and procedures related to ethics review preparedness. The workshop considered five areas where work might be undertaken to facilitate rapid and sound ethics review: preparing national ethics committees for outbreak response; pre-review of protocols; multi-country review; coordination between national ethics committees and other key stakeholders; data and benefit sharing; and export of samples to third countries. In this paper, we present the recommendations that resulted from the workshop. In particular, the participants recommended that Ethics Committees would develop a formal national standard operating procedure for emergency response ethical review; that there is a need to clarify the terminology and expectations of pre-review of generic protocols and agree upon specific terminology; that there is a need to explore mechanisms for multi-country emergency ethical consultation, and to establish procedures for communication between national ethics committees and other oversight bodies and public health authorities. In addition, it was suggested that ethics committees should request from researchers, at a minimum, a preliminary data sharing and sample sharing plan that outlines the benefit to the population from which data and samples are to be drawn. This should be followed in due time by a full plan. It is hoped that the national ethics committees, supported by the WHO, relevant collaborative research consortia and external funding agencies, will work towards bringing these recommendations into practice, for supporting the conduct of effective research during outbreaks. This study characterizes a large sample of adults with attention-deficit/hyperactivity disorder and healthy controls regarding their task performance and neurophysiology; cross-sectionally and longitudinally. Self-reported symptoms, behavioral measures, and event-related potentials from a classical cued Go/NoGo task were used to outline the symptom burden, executive function deficits and neurophysiological features, and the associations between these domains. The study participants were assessed five or three times over two years. We describe cross-sectional and longitudinal group differences, and associations between symptom burden, and behavioral (...) and event-related potential components variables by latent growth curve models, including random slopes and intercepts. The ADHD group showed increased reaction time variability, increased commission and omission errors, and attenuated cueP3, CNV, N2d, and P3d amplitudes. We observed a decrease in self-reported symptoms in the ADHD group over the two years. The behavioral measures did not change over time, whereas the cueP3, P3d, and N2d amplitude attenuated in both groups. There was no evidence for a robust association between symptom burden and behavioral or ERP measures. The changes in the ERP components with stable task performance, potentially indicate more efficient neuronal processing over the two years. Whether the lack of association between symptom burden and behavioral or ERP measures might be due to the low reliability of the ADHD assessment criteria, or the inappropriateness of the objective measures cannot be inferred. The innovative field of Regenerative Medicine (RM) is expected to extend the possibilities of prevention or early treatment in healthcare. Increasingly, clinical trials will be developed for people at risk of disease to investigate these RM interventions. These individuals at risk are characterised by their susceptibility for developing clinically manifest disease in future due to the existence of degenerative abnormalities. So far, there has been little debate about the ethical appropriateness of including such individuals at risk in clinical trials. We (...) discuss three main challenges of selecting this participant model for testing RM interventions: the challenge of achieving a proportional risk–benefit balance; complexities in the trial design in terms of follow-up and sample size; and the difficulty of obtaining informed consent due to the many uncertainties. We conclude that selecting the model is not ethically justifiable for first-in-man trials with RM interventions due to the high risks and uncertainties. However, the model can be ethically appropriate for testing the efficacy of RM interventions under the following conditions: interventions should be low risk; the degenerative abnormalities (and other risk factors) should be strongly related with disease within a short time frame; robust preclinical evidence of efficacy needs to be present; and the informed consent procedure should contain extra safeguards with regard to communication on uncertainties. Background Notwithstanding the need to produce evidence-based knowledge on medications for pregnant women, they remain underrepresented in clinical research. Sometimes they are excluded because of their supposed vulnerability, but there are no universally accepted criteria for considering pregnant women as vulnerable. Our aim was to explore whether and if so to what extent pregnant women are vulnerable as research subjects. Method We performed a conceptual and empirical analysis of vulnerability applied to pregnant women. Analysis A conceptual analysis supports Hurst's definition (...) of vulnerability. Consequently, we argue that pregnant women are vulnerable if they encounter an identifiably increased likelihood of incurring additional or greater wrong. According to the literature, this increased likelihood could exist of four alleged features for pregnant women's vulnerability: informed consent, susceptibility to coercion, higher exposure to risk due to lack of knowledge, vulnerability of the fetus. Discussion Testing the features against Hurst's definition demonstrates that they all concern the same issue: pregnant women are only vulnerable because a higher exposure to risk due to lack of scientific knowledge comprises an increased wrong. Research Ethics Committees have a responsibility to protect the vulnerable, but a higher exposure to risk due to lack of scientific knowledge is a much broader issue and also needs to be addressed by other stakeholders. Conclusions The only reason why pregnant women are potentially vulnerable is to the extent that they are increasingly exposed to higher risks due to a lack of scientific knowledge. Accordingly, the discussion can advance to the development of practical strategies to promote fair inclusion of pregnant women in clinical research. (shrink)

In the standard volunteer’s dilemma (VoD), a single prosocial act (i.e., volunteering) yields the optimal overall outcome. Whereas the volunteer’s outcome is certain, the defector’s outcome depends on what others do. This research addressed the confounding of prosocial responses with uncertainty avoidance in the standard VoD. In Experiment 1, participants (N = 102) considered 18 hypothetical one-shot two-person VoD scenarios with certain, risky, and uncertain outcomes when volunteering. In Experiment 2, participants (N = 496) considered three hypothetical one-shot two-person VoD (...) scenarios; a certain VoD and two uncertain VoDs of which one had a lower expected collective outcome of volunteering than the certain VoD and the other a higher one. Results suggest that volunteering does not reflect a desire to avoid uncertainty but to maximize expected collective outcomes, reinforcing the assumption that the high volunteering rates we see in a standard VoD are due to social/moral preferences and social projection. The Dutch law states that a physician may perform euthanasia according to a written advance euthanasia directive when a patient is incompetent as long as all legal criteria of due care are met. This may also hold for patients with advanced dementia. We investigated the differing opinions of physicians and members of the general public on the acceptability of euthanasia in patients with advanced dementia.

In the missionary activities that Halle theologians developed in the first half of the 18th century Grotius’ De veritate plays an interesting role that deserves exploration. To that purpose, the history and nature of the publication of missionary tracts in Halle will be surveyed, the role therein of Johann Heinrich Callenberg and his Institutum Judaicum at Muhammedicum described and the distribution and reception of the texts among the Muslims and Jews that were the target of the Halle missions all over (...) the world summarized and analysed. It is suggested that Grotius’ De veritate, which was an atypical piece of apology in the Halle pietist setting, stands out among the other literature for its efficacy in the missionary process, due to its non-dogmatic character. Johann Bernoulli in 1710 affirmed that Newton had not proved that conic sections, having a focus in the force centre, were necessary orbits for a body accelerated by an inverse square force. He also criticized Newton's mathematical procedures applied to central forces in Principia mathematica, since, in his opinion, they lacked generality and could be used only if one knew the solution in advance. The development of eighteenth-century dynamics was mainly due to Continental mathematicians who followed Bernoulli's approach rather than (...) Newton's. The ways of thinking of the British Newtonians have, therefore, been somewhat forgotten. This paper is an attempt to assess what Bernoulli was criticizing and what were the immediate reactions of the Newtonians. In particular, I will concentrate on two papers by John Keill, submitted to the Royal Society in 1708 and 1714, in which the results on central forces achieved by the British were summarized and their methods defended. To systematically understand and study Herbart's educational reform, and at the same time scientifically and reasonably design the intervention strategy of educational practice, are two core issues facing the current educational reform and development. The purpose of this study is to clarify Herbart's educational thought, overcome the deviation and error in understanding it, and provide theoretical guidance and support for educational practice. From the perspectives of history, sociology and pedagogy, the paper explores the historical background of educational practice and its (...) theoretical development, and combines three stages of the formation and evolution of educational social experiments from the perspective of epistemology. Firstly, the theory of children's morality is regarded as the interactive bridge between practical philosophy and moral education practice. Secondly, the dynamic relationship between philosophy of knowledge and practice of intellectual education is explored through empirical theory. Finally, the paper analyzes the interaction between aesthetic philosophy and aesthetic education practice based on children's interests. The study of the dynamic construction process of Herbart pedagogy is conducive to clarifying Herbart's educational thought and provide a new perspective to the current generation. Due to the complexity and diversity of educational practice, research may have certain limitations and challenges in applying Herbart's theory to specific educational practice. Future research needs to strengthen the exploration of educational practices, especially in the era of intelligence, to adapt to changing educational needs and technological advances. (shrink)

“Sacra à Deo in corde discenda, natura ex natura.” Johann Christian Senckenberg's Observationes as a Medico-Theological Writing Method. In his early diaries, the pietist physician Johann Christian Senckenberg has taken down large amounts of observation data which mostly concentrated on his own body and soul. Earlier research has mistaken his diligent self-observation for hypochondria and unworldliness, especially since the author had never endeavoured to analyze and publish his work. The article shows that both his writing practice and his reluctance to (...) process and share its results are due to his deeply religious and firmly anti-rationalist conviction. The main purpose of his journal keeping was the attainment of religious self-knowledge and professional self-perfection. Scientific publications he considered to be hypothetical and dogmatic, be it in theology or medicine; moreover, their authors were often enough driven by their self-love and desire for fame. In his eyes, the only godly way of knowledge acquisition was the humble, diligent and minute study of divine creation according to the Hippocratic method. The most immediate and reliable way of achieving true wisdom, however, was the observation of God's work within one's own body and mind, which were subject to the effects of God's grace and punishment as well as to atmospheric, environmental and dietetic circumstances.
